CALIFORNIA PROBATION

To expunge a conviction, the probation period must have been completed. In some cases, the defendant can ask the court to terminate the probation early so that a petition to expunge the record can be filed.

Termination of probation is determined by:

  • The time you have already successfully served on probation or house arrest;
  • Whether you have been re-arrested or charged with a new offense since being placed on supervision;
  • Whether your restitution, court costs, and supervision fees have all been paid.
  • All classes have been completed.
